Welcome to Kalfas Property Solutions. By accessing or using our website and services, you agree to comply with and be bound by these Terms and Services. If you do not agree with any part of these terms, please do not use our services. These terms constitute a legally binding agreement between you and Kalfas Property Solutions regarding your use of our property management services and website.
Kalfas Property Solutions provides comprehensive property management services including tenant placement, rent collection, maintenance coordination, financial reporting, and legal compliance management. Specific services provided will be detailed in individual Property Management Agreements. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to clients.
Property owners agree to: maintain adequate property insurance, disclose all known property defects, provide necessary repair budgets when required, comply with all applicable laws and regulations, maintain property in habitable condition, respond promptly to emergency communications, provide access to properties for inspections and showings, and pay all associated management fees as agreed.
Management fees are calculated as a percentage of monthly collected rent or fixed fee as specified in your Property Management Agreement. Fees are deducted from rent collections before owner disbursement. Additional fees may apply for tenant placement, lease renewals, maintenance coordination, eviction services, and specialized reporting. All fees are disclosed in advance and documented in your service agreement.
While we conduct comprehensive tenant screening including credit checks, criminal background verification, employment verification, and rental history validation, we cannot guarantee tenant behavior or future payment performance. We follow all Fair Housing laws and Equal Opportunity guidelines in tenant selection. Property owners retain final approval authority on tenant selection.
We coordinate maintenance and repairs with licensed, insured contractors. For emergency repairs, we have authority to spend up to the limit specified in your Property Management Agreement without prior approval. Non-emergency repairs exceeding specified amounts require owner approval. We are not liable for contractor work quality or delays, though we diligently vet all service providers.
We collect rent, manage security deposits according to state laws, pay approved property expenses, and disburse remaining funds to owners monthly. Detailed financial statements are provided monthly. We maintain separate trust accounts for client funds as required by law. Owners receive annual tax summaries but should consult their tax professionals for specific advice.
Either party may terminate the Property Management Agreement with written notice as specified in your agreement (typically 30-90 days). Upon termination, we will provide all property documents, security deposits held, and final accounting. Early termination fees may apply as specified in your agreement.
To the maximum extent permitted by law, Kalfas Property Solutions shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from service provision. Our total liability shall not exceed the fees paid in the three months preceding the claim.
These terms shall be governed by and construed in accordance with the laws of the United States and the state where services are provided, without regard to conflict of law provisions.
We reserve the right to modify these terms at any time. Material changes will be communicated via email or website notice at least 30 days in advance. Continued service use constitutes acceptance of modified terms.
These terms, together with your Property Management Agreement, constitute the entire agreement between you and Kalfas Property Solutions regarding service provision.
